I have posted my latest article on Soumya Murder Case and Justice Katju’s criticism of the Supreme Court’s decision acquitting the accused of murder charges on Practical Academy. The blog post can be accessed HERE.
The Article has a detailed analysis of the facts of the case Govindswamy v. State of Kerala, the arguments put forth by the state and the defence attorney, and the decision passed by the Supreme Court bench.
The judgement holds the accused liable for rape, causing grievous hurt voluntarily among other charges. However, it acquits him of murder charges on the basis of hearsay evidence. Hence, Justice Katju’s had condemned the decision calling it a grave error on his Personal Blog, after which the the Supreme Court bench took suo motu notice of the blog post and asked him to appear in the open court in order to have a debate on the same.
